Do I need a permit for a dumpster in Orange County?

Short answer: a dumpster on your own driveway or private property almost never needs a permit in Orange County. A dumpster set in the public street, alley or sidewalk area usually does — cities call it an encroachment or right-of-way permit, and the property owner or contractor pulls it from the city public works department.

Driveway placement: no permit in almost every city

If the container sits entirely on private property with the truck able to back in and out legally, cities such as Anaheim, Irvine, Santa Ana, Huntington Beach, Mission Viejo and Fullerton do not require a permit.

HOA-governed communities like Ladera Ranch, Coto de Caza, Aliso Viejo and much of Irvine are the exception in practice: the city does not require a permit, but your HOA may limit how many days a container can sit in view. Check your CC&Rs before you book a long rental.

Street placement: expect an encroachment permit

Placing a roll-off in the public right of way blocks a traffic or parking lane, so cities want it permitted, reflectorized and time limited. Fees and durations vary by city, and some require the permit number posted on the container.

Ways to avoid the permit entirely

Use the driveway and park vehicles on the street for the rental period. A 10 or 15 yard lowboy fits where a 20 yard will not, and low walls make loading faster.
